Words whose initial letter is capitalized have meanings defined in the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

• FitCal: Referred to as "Company", "We", "Us", or "Our" in this agreement.
• Device: Any device that can access the Service, such as a computer, phone, or tablet.
• Service: The FitCal mobile application and the website accessible at fitcalai.app.
• You: The individual accessing or using the Service.

2. Acknowledgment

These Terms and Conditions govern the use of FitCal and set out the rights and obligations of all users in relation to the Service.

• Acceptance of Terms: By accessing or using FitCal, You agree to be bound by these Terms.
• Age Requirements: You represent that you are over 18 years of age. FitCal does not allow those under 18 to use the Service.
• Privacy Policy: Your access and use are also conditioned on accepting our Privacy Policy.

3. Features and Permissions

• Camera and Photo Library Permission: Necessary to analyze food images and calculate calories.
• Personal Data: Name, email, and phone are collected for communication and marketing, ensuring security.
• Explicit Consent: All permissions are requested clearly, as per local laws.

5. Termination

We may terminate or suspend your access to FitCal immediately, without prior notice, if You violate these Terms or misuse the Service.

6. Limitation of Liability

FitCal's total liability will be limited to the amount paid by You for the Service or $50, if no payment was made.

7. Changes to Terms and Conditions

We reserve the right to modify these Terms at any time. We will notify you of major changes at least 30 days in advance.
